For purposes of these terms and conditions, max impact is used as a sample name, or “placeholder”, for an actual church, ministry or nonprofit name. max impact is for illustration purposes only.

 

This SMS service is operated by mobileAxept on behalf of its client, max impact, the provider of all message content sent to you. These terms and conditions govern your use of mobileAxept’s SMS service operating on any mobileAxept enabled 5-digit short code or 10-digit long code. Your use constitutes your express agreement to these terms and conditions. mobileAxept reserves the right to change these terms and conditions at any time without notice. Your cell carrier is not responsible for any delayed or undelivered SMS messages. Contact your wireless carrier for pricing details if you have any questions regarding your plan’s specific SMS rates as message and data rates may apply.

 

max impact’s single-use message and/or recurring-use message programs require you to opt-in, or subscribe to, in order to participate. A single-use program is one where you send an SMS message to a 5-digit short code or 10-digit long code in order to initiate a donation to max impact. A recurring-use program is one where you opt-in to receive periodic (3-4 times per month) informational alerts from max impact. To stop receiving messages on any max impact recurring-use program to which you have subscribed, text STOP, END, CANCEL, UNSUBSCRIBE or QUIT. You will not be sent Unsolicited SMS messages.

mobileAxept will not sell or provide your personal information to any third-party without your express consent. For more information, please review mobileAxept’s Privacy Policy.

 

mobileAxept may terminate this agreement or your account at any time in its sole discretion. You agree that mobileAxept shall not be liable to you or any third-party for any interruption, termination or disabling of this service. Your use of this service expressly allows mobileAxept to send you information concerning helpful hints or service updates. While you are subscribed to any program, we reserve the right to ask you for comments on how to improve services.

 

You agree to hold mobileAxept, and its affiliates and their respective directors, officers, employees and agents, harmless from and against any and all claims, actions, demands, damages, costs, liabilities, losses and expenses (including reasonable attorneys’ fees) arising out of your use of this service. These terms and conditions will be governed by and construed in accordance with the laws of the state of Minnesota, without giving effect to the conflict of laws or provisions of Minnesota or your actual state or country of residence. Any dispute arising from these terms and conditions shall be adjudicated in the federal or state courts located in Hennepin County in Minnesota. If for any reason a court of competent jurisdiction finds any provision or portion of these terms and conditions to be unenforceable, the remainder will continue in full force and effect. These terms and conditions constitute the entire agreement with respect to the subject matter hereof and supersedes and replaces all prior or contemporaneous understandings or agreements, written or oral, regarding such subject matter. Any waiver of any provision of these terms and conditions will be effective only if in writing and signed by mobileAxept.
